EL VALLE GOLF RESORT OWNERS COMMUNITY, responsible for the website, welcomes you and makes available to users this document, with the intention of fulfilling the obligations set forth in Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), BOE No. 166, as well as informing all users of the website about the terms and conditions of its use.

This document details the Terms and Conditions (T&C) that govern your use of the website (EVGR.org), the residential area platform, and our mobile applications for Android and iOS devices. In the case of any discrepancies or differences in interpretation between the English translation and the Spanish original, the Spanish version shall prevail as the authoritative text. 1.1 Purpose of the Terms and Conditions

The purpose of these T&C is to define the legal framework in which users may access and use the services provided by EVGR.org. This includes, but is not limited to, the informational content of the website, the interactive features of the residential area platform, and the functionalities offered through the mobile applications.

These T&C aim to:

Acceptance of these T&C is a prerequisite for using this website and EVGR's mobile applications. General Use of the Website

2.1 Access and Use of the Website

The EVGR.org website aims to provide information and services related to the El Valle Golf Resort Community. Users are granted a limited, non-exclusive, and non-transferable right to access and use the website for personal and non-commercial purposes, subject to compliance with these Terms and Conditions.

This license does not include the right to resell or commercially use the website or its contents; any collection and use of descriptions, or any derivative use of the website or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

2.3 Content Ownership and Copyright

Content provided by EVGR.org, including text, images, and other materials, is either owned by the EVGR Community or licensed to it, and is protected by copyright and other intellectual property laws. Users may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the website without the express written consent of the EVGR Administration.

User-generated content, such as comments, posts, or images, remains the intellectual property of the individual user. By posting content on the Residential Platform, the user grants the EVGR Administration a non-exclusive, royalty-free, perpetual, and irrevocable right to use, modify, adapt, and translate the content.

2.4 Prohibited Conduct

Users of the EVGR.org website are expected to behave in a respectful and lawful manner at all times. The following conduct is expressly prohibited:

  • Posting or transmitting any material that is illegal, threatening, abusive, defamatory, obscene, pornographic, or profane.
  • Engaging in any behavior that would constitute a criminal offense or give rise to civil liability.
  • Using the website to impersonate other parties or entities.

2.9 Email Newsletter Subscription

Residential Area Platform

The Terms and Conditions detailed in this section specifically apply to registered users of the Residential Area Platform (https://evgr.org/en/community, https://evgr.org/es/comunidad, https://evgr.org/en/reports, https://evgr.org/es/informes) of EVGR.org and do not apply to regular site visitors without an account. By registering and using the Residential Area Platform, users agree to comply with these additional T&C, which govern the specific functionalities and services offered within the platform.

3.1 Eligibility and Registration

To be eligible for registration on the Residential Area Platform, users must be current owners of property, tenants, or full-time residents at El Valle Golf Resort. Registration requires users to provide accurate and complete information as indicated in the registration form, which may include personal details, contact information, and proof of residence or ownership. Users are responsible for ensuring that their use of the platform complies with all local, national, and international laws and regulations. Upon submitting the registration form, users will receive a confirmation email and additional verification steps may be required to confirm their eligibility. The EVGR Administration reserves the right to reject any registration request that does not meet the eligibility criteria or fails to provide the necessary documentation.

3.2 Account Verification Process

After registration, the account verification process begins to ensure that all platform users are legitimate members of the El Valle Golf Resort Community. The verification process involves reviewing the documentation provided, such as proof of address or ownership, against the internal records maintained by the resort administration.

The verification process may take up to 30 days, and during this period, access to certain platform features may be restricted. Once the verification process is completed, users will be granted full access to the platform's features, subject to the T&C established here. The EVGR Administration reserves the right to request additional information or documentation as part of the verification process. Failure to provide such information may result in the suspension or termination of the user's account.

3.3 Division of Owners and Tenants

The Residential Area Platform distinguishes between two types of user profiles: Owners and Tenants. Owners are verified property owners within the resort, while Tenants are verified residents renting property within the resort. Owners will receive a visible blue badge next to their name on their profile, indicating their status as verified owners. This badge grants them access to exclusive areas of the platform intended for owners, such as the "Owners Group". Both Owners and Tenants have access to general platform features; however, certain areas and functionalities are exclusive to Owners.

3.4 User Responsibilities

Users are responsible for maintaining the confidentiality of their account information, including their password, and for all activities that occur under their account. Users agree to immediately notify the EVGR Administration of any unauthorized use of their account or any other security breach. Users are also responsible for ensuring that their conduct on the platform complies with these T&C and does not infringe upon the rights of other users or third parties. This includes respecting the privacy and intellectual property rights of others and refraining from any form of harassment, abuse, or discrimination.

3.5 Content and Conduct Guidelines

The EVGR Administration expects all users to adhere to the highest standards of conduct and respect the community-oriented nature of the platform. The following guidelines should be followed when posting content and interacting with other users:

  • Content should be appropriate, respectful, and not infringe upon the rights of others.
  • Posting illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, defamatory, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable material is not allowed.
  • Users should not impersonate any person or entity or falsely claim or misrepresent their affiliation with any person or entity.
  • Unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, pyramid schemes, or any other form of solicitation is prohibited.
  • Users should not upload, post, email, transmit, or otherwise make available any content of which they do not have the right to make available under any law or under contractual or fiduciary relationships (such as insider information, confidential information, and proprietary information learned or disclosed as part of employment relationships or under nondisclosure agreements).
  • Users should not upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.

Compliance with these content and conduct guidelines is essential for maintaining a positive and constructive environment on the platform. The EVGR Administration reserves the right to review, edit, or remove any content that violates these guidelines or is deemed inappropriate.

3.6 Privacy and Information Sharing

Privacy is of utmost importance on the Residential Area Platform. Users must treat all personal information shared by other users within the platform with confidentiality and respect. Sharing another user's personal information, including contact details, posts, photos, and any other posted content, without explicit written permission from the data owner, is strictly prohibited. The platform allows users to control the privacy settings of their profiles and the information they share. Users can choose to make their data completely private, share it only with friends, or make it visible to all registered residents. However, certain information, such as the name, avatar (profile picture), and cover image, will always be visible to all registered and logged-in users. Users have the right to remove their profile picture or use a pseudonym as their name, but this may affect the verification process and access to the platform. Private or group direct messaging is confidential and cannot be monitored or reviewed by moderators. Users are encouraged to exercise caution and discretion when sharing personal information through direct messages.

3.7 Moderation and Reporting

The Residential Area Platform is moderated to ensure a safe and respectful environment. Moderators have the authority to remove any content that violates the T&C, platform content and conduct guidelines, or is deemed inappropriate without prior notice. Users have the ability to report content they believe violates the T&C or is offensive, abusive, or inappropriate. Reported content will be reviewed by moderators, who will take appropriate action, which may include removing the content and/or disciplinary actions against the responsible user. Moderators, subject to a Non-Disclosure Agreement, maintain strict standards of privacy and confidentiality. To effectively perform their moderation responsibilities, they have access to all posts, including content with different privacy settings.

3.8 Use of the Marketplace

The Marketplace feature of the Residential Area Platform allows users to advertise items for sale, rent, or as gifts. Users must ensure that all items listed on the Marketplace are legal and appropriate for sale. Items such as illegal substances, alcohol, tobacco, medications, weapons, and counterfeit or stolen goods, among others, are prohibited. Users are responsible for the accuracy and legality of the content they post on the Marketplace and must comply with all applicable laws regarding the sale or exchange of goods and services. The EVGR Administration is not responsible for transactions that occur as a result of postings on the Marketplace and does not provide any form of buyer or seller protection.

3.9 Participation in Events and Groups

Users are encouraged to participate in events and join groups within the Residential Area Platform. Events can be official, organized by the administration, or unofficial, organized by residents. Groups may include groups dedicated to Residents and Owners, as well as community-managed groups. Users organizing events or managing groups must ensure that all activities are conducted in accordance with the T&C and platform content and conduct guidelines. The EVGR Administration reserves the right to remove any events or groups that violate these terms or are deemed inappropriate.

3.10 Incident Reporting and Forum Use

The Reports section serves as a forum optimized for reporting and tracking incidents. Users can report incidents or discuss community-related issues within this section. All users are expected to report incidents truthfully and constructively. The forum is moderated, and users must adhere to the content and conduct guidelines when participating in discussions. The EVGR Administration may take action on reported incidents, including sending reports to appropriate authorities or the resort management, as necessary.

3.11 Account Termination and Suspension

The EVGR Administration reserves the right to suspend or terminate a user's account for any violation of these T&C, misuse of the platform, or any other conduct detrimental to the community or platform integrity. Upon suspending or terminating an account, users will lose access to their account and may be prohibited from registering for a new account. The EVGR Administration will communicate the decision to the affected user, including the reason for termination or suspension and any applicable appeal process.

Use of the Mobile Application

The EVGR.org mobile applications for Android and iOS provide users with access to the functionalities of the Residential Zone Platform on their mobile devices. These applications are extensions of the platform and are subject to the same Terms and Conditions, with additional provisions specific to mobile use.

4.1. Application Functionality

The mobile applications offer functionalities similar to the residential zone on the EVGR.org website, including real-time posting, photo uploads, marketplace listings, group and event participation, direct messaging, and incident reporting. Users should ensure that their devices meet the necessary technical requirements for installing and using the applications.

4.2. User Conduct within the Application

Users are expected to maintain the same standards of conduct within the mobile applications as on the website. All content and interactions must comply with the platform's content and conduct guidelines. Any misuse of the application, such as sending unwanted messages or engaging in prohibited activities, may result in the suspension or termination of the account.

4.3. Data Usage and Privacy

The mobile applications may use data to provide and improve services. Users should be aware of the limits of their mobile data plan and associated costs. The EVGR Administration is committed to protecting user privacy and ensuring that data collection and usage comply with the Privacy Policy and applicable data protection laws.

4.4. Application Updates and Maintenance

The EVGR Administration may provide updates or maintenance to the mobile applications from time to time to enhance functionality, improve security, or address errors. Users are encouraged to install all updates to ensure the best possible experience and maintain compatibility with platform services. Users may be required to update the application to continue using it, and the EVGR Administration is not responsible for issues arising from the use of outdated versions of the application. Regular maintenance may also be performed, during which the application may be temporarily unavailable. Users will be notified of any significant downtime in advance whenever possible.

User Rights and Responsibilities

As registered users of the EVGR.org Residential Zone Platform, certain rights are granted to users regarding their personal data, and they are also expected to fulfill specific responsibilities to maintain the integrity and security of the platform.

5.1. Data Deletion and Export

In compliance with the General Data Protection Regulation (GDPR), users have the right to request the deletion of their personal data ("right to be forgotten") from the platform. Users may also request the export of their data in a readable format. 5.2. Account Security

Users are responsible for maintaining the confidentiality of their account credentials, including their username and password. Users should take reasonable steps to prevent unauthorized access to their accounts, such as choosing secure passwords and not sharing their login information with others. In case of any suspected unauthorized use of an account or security breach, users should immediately report it to the EVGR Administration. The administration will take appropriate action to address the issue, which may include temporarily suspending the account while investigating the matter.

5.3. Usage Policy

The platform is intended for personal, non-commercial use by residents of the El Valle Golf Resort Community. Users are expected to engage in fair use of the platform, which means not overloading the system with excessive content, not using automated means to access or use the platform, and not using the platform in a way that negatively affects other users or the platform's performance.

5.4. One Account Policy

Users are allowed to create and operate only one personal account on the platform. Creating multiple accounts by an individual is strictly prohibited. Users must not share access to their account with anyone else or operate an account on behalf of another person. Any violation of this policy may result in the suspension or termination of all associated accounts.

Security and Reporting

Ensuring the safety and well-being of all users within the El Valle Golf Resort Community platform is a top priority. The platform is designed to be a secure environment where residents can interact, share information, and participate in community life with peace of mind.

6.1. Reporting Inappropriate Content

If users encounter content they deem inappropriate, offensive, or in violation of the platform's Terms and Conditions, they are encouraged to use the reporting feature immediately. This feature is accessible within the platform interface (usually in the top right corner of the item), allowing users to flag content for review by the moderation team. The moderation team will promptly investigate all reports and take appropriate actions, which may include removing the content and addressing the behavior of the user who posted it.

To maintain a secure environment, users are advised to follow the following security guidelines:

  • Protect personal information by being cautious about the amount of detail shared in posts, comments, and messages.
  • Stay vigilant against phishing attempts and suspicious links. Do not click on links from unknown sources.
  • Immediately report any suspicious behavior or content to the moderation team or administration.
  • Follow platform privacy settings to control who can see your information and posts.
  • Respect the privacy and security of others by avoiding sharing personal information without consent.

Limitations and Access

The EVGR Administration strives to provide continuous and reliable access to the platform; however, users should be aware of certain limitations that may affect availability and data integrity.

7.1. Platform Availability

While the administration aims to ensure that the platform is available 24/7, there may be occasions when the platform is inaccessible due to maintenance, updates, or unforeseen technical issues. Users will be notified in advance of any planned downtime whenever possible. The administration does not guarantee uninterrupted access to the platform and its services and will not be liable for any inconvenience or loss of information due to downtime.

7.2. Data Backup and Loss Prevention

To maintain the highest standards of data security and compliance, the EVGR.org Residential Area Platform implements rigorous data protection measures. Our commitment to safeguarding user information is reflected in our adherence to internationally recognized standards, including PCI DSS for secure credit card transactions, HIPAA for health information protection, NIST guidelines for cybersecurity, and GDPR for data privacy within the EU.

To mitigate the risk of data loss, our platform performs regular encrypted backups, which are securely stored within the AWS Cloud infrastructure located in the EU. This ensures not only redundancy but also strict compliance with the latest data protection regulations. Although we provide robust data protection measures, we encourage users to create personal backups of their critical data to further protect themselves against potential data loss.

The administration assumes no responsibility for data loss that users have not independently secured. Our platform employs a comprehensive set of security technologies, including advanced DNS security, DDoS protection, Transport Layer Security (TLS) V1.2+, and Web Application Firewall (WAF) optimizations. These measures are part of our commitment to maintaining a secure online environment. Despite these precautions, we recognize that no system is infallible. Therefore, users are urged to exercise due diligence when using the platform and promptly report any security concerns to the administration. Our proactive security stance ensures that we continuously assess and improve our defenses to protect user data.

Modifications to the Terms and Conditions and the Platform The EVGR Administration reserves the right to modify these Terms and Conditions at any time to reflect changes in the law, new regulatory requirements, improvements to the platform, or enhancements to user services.

8.1. Notification of Changes

Any modification to these Terms and Conditions will be communicated to users through the platform's notification system or via email to the address associated with their account. The date of the last update will also be clearly displayed at the top (or bottom) of the Terms and Conditions document on the platform. Users are responsible for regularly reviewing the Terms and Conditions to stay informed of any changes. Continued use of the platform after changes will constitute acceptance of the modified Terms and Conditions.

8.2. Acceptance of Modified Terms

By continuing to access or use the platform after modifications, users affirm their agreement to comply with the updated Terms and Conditions. The EVGR.org Residential Community Platform is committed to continuous improvement and innovation to enhance user experience and community engagement. As part of this commitment, the platform may undergo modifications, including but not limited to, the addition, alteration, or removal of features and functionalities. The following clause describes our approach to platform modifications and feature changes:

• Users will be notified of significant changes to platform features or functionalities through announcements on the platform or via email communication.

• Changes to the platform may be made to improve user experience, increase security, comply with legal requirements, or align with evolving community needs.

• The administration will make reasonable efforts to ensure that feature changes do not cause undue inconvenience to users. However, some changes may result in modification or removal of certain functionalities that users may have relied upon.

Applicable Law, Jurisdiction, and Data Retention

The Terms and Conditions, as well as any dispute that may arise between users and the EVGR Homeowners Community, shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of laws provisions.

9.1. Applicable Law

These Terms and Conditions are established in accordance with Spanish law. In the event of any legal proceedings, the laws of Spain shall apply.

9.2. Dispute Resolution

Any dispute arising in connection with these Terms and Conditions shall be resolved through negotiation between the user and the EVGR Representative. If a resolution cannot be reached, the dispute may be submitted to the competent courts located in Murcia, Spain.

9.3. Data Retention Policy

The EVGR.org Residential Community Platform serves as a digital space for community interactions and, as such, collects and stores various forms of user data and content. To ensure transparency and trust, the platform follows the following Data Retention Policy:

  • User data and content, such as posts, messages, images, and other media, will be retained on the platform as long as the user account remains active, or for a period deemed necessary for the purposes for which it was collected, in compliance with applicable laws and regulations.
  • Users have the right to delete their own content or request its deletion by contacting the administration. However, some data may be retained in encrypted backups for a reasonable period even after deletion requests, as part of our data protection strategy.
  • In case of account termination, whether by the user or by the administration due to a breach of the Terms and Conditions, user data and content may be retained for a legally required period to fulfill legal obligations, resolve disputes, and enforce our agreements.
  • The EVGR administration will conduct periodic reviews of stored data and delete data that is no longer necessary or relevant for the operation of the platform or legal compliance.

Effective Date and Acknowledgement

These Terms and Conditions are effective as of the date of the last update and replace any previous versions. By using the platform, users acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions.
